The rapid adoption of artificial intelligence (AI) is creating new governance challenges for Australia’s public sector. In its recent report, Beware the Gap: Governance Arrangements in the Face of AI Innovation, ASIC highlights the risk of a growing gap in governance as AI use expands, urging public sector leaders to proactively adapt governance frameworks to meet the demands of AI-driven operations. ASIC Chair Joe Longo cautions, “There is the potential for a governance gap—one that risks widening if AI adoption outpaces governance in response to competitive pressures.”

Addressing AI governance gaps

ASIC’s in-depth review of AI practices across 23 financial licensees has revealed significant governance gaps, particularly around fairness and transparency. Nearly half of these firms have yet to implement sufficient policies to address consumer fairness and prevent bias, while even fewer have guidelines to ensure transparency in AI-driven decision-making. These findings highlight an urgent need for robust frameworks to mitigate risks, including:

  1. Consumer fairness and bias

ASIC’s latest report reveals that nearly half of financial licensees lack policies to address consumer fairness and prevent bias, posing significant risks for unintended discrimination. Without these policies, AI systems could inadvertently influence consumer sentiment or embed biases that distort decision-making, eroding public trust. ASIC Chair Joe Longo warned, “Without appropriate governance, we risk seeing misinformation, unintended discrimination or bias, manipulation of consumer sentiment, and data security and privacy failures.” These findings highlight the urgency for both the financial and public sectors to adopt fair, unbiased AI practices to uphold credibility and ethical standards.

  1. Transparency in AI-driven decision-making

ASIC found that many organisations lack transparency policies, and few require disclosures about AI’s impact on consumer decisions. Public entities that lack transparency create ambiguous decision-making processes, reduce accountability, and heighten public concerns about privacy. AI increasingly influences consumer choices. ASIC emphasises that public sector leaders must maintain transparency by ensuring citizens understand AI’s role in the outcomes that impact their lives. Longo emphasised the urgent need, stating, “It is clear that work needs to be done—and quickly—to ensure governance is adequate for the potential surge in consumer-facing AI.”

AI relies on vast amounts of data, which raises significant privacy concerns, especially if regulatory frameworks do not evolve with technological advancements. Poor policies lead to improper management of sensitive information, impacting individual privacy and compromising the overall integrity of data in the public sector. ASIC examined 624 AI applications among various licensees and found a rapid increase in adoption, with 60% of licensees planning to significantly enhance their use of AI. This trend challenges existing governance frameworks and reveals vulnerabilities in data security and privacy safeguards. Public sector organisations must implement thorough data management policies to safeguard against privacy breaches and ensure citizens’ rights regarding their data.

  1. Operational and ethical concerns in AI deployment

Weak governance frameworks can lead to the misuse of AI, jeopardising consumer trust and eroding public confidence in digital government systems. The ASIC warns about the potential risks linked to public sector AI applications. Without strong governance, these technologies can unintentionally perpetuate bias, mislead the public, or undermine ethical principles. In order to uphold ethical standards in all outsourced AI activities, ASIC calls on licensees to implement thorough due diligence procedures to critically assess third-party AI providers. This strategy safeguards operational integrity and maintains public perception in the public sector.

  • Ongoing Framework Updates: Governance frameworks must adapt alongside the progress of AI technologies. “This can only happen if adequate governance arrangements are in place before AI is deployed,” emphasises ASIC Chair Longo. Leaders must establish organised procedures for consistent updates to ensure that governance policies remain relevant as AI systems expand.
  • Transparency and Consumer Accountability: ASIC underscores the need for clarity in AI functions, urging organisations to disclose their use of AI in decision-making activities. Transparency plays a crucial role in the public sector, forming the foundation of consumer trust. Leaders must implement policies that mandate transparent communication about the role and influence of AI.
  • Ethical Use and Bias Prevention: Responsible AI implementation starts with ethical application, ensuring fairness, and effectively addressing bias. ASIC found that many organisations lacked policies to address these issues. Public sector entities must focus on fairness and equity by integrating bias-prevention strategies into AI frameworks.
  • Due Diligence in Third-Party AI Integration: “This includes proper and ongoing due diligence to mitigate third-party AI supplier risk,” Longo points out. The public sector conducts thorough evaluations of external AI providers to ensure they meet ethical and operational benchmarks.

Strengthening governance and trust

Governance gaps significantly impact digital transformation efforts within Australia’s public sector. Bias and discrimination in AI-driven government services threaten public trust and create disparities in service delivery. AI decision-making processes lack clarity, obstructing accountability and complicating the resolution of errors or biases.
